連環自殺已被遺忘?富士康故態復萌!

全球電子業勞工及環境倡議運動 (GoodElectronics)、民間可持續社會發展中心(Bread for All)、大學師生監察無良企業行動(SACOM)、公平電子貿易聯盟(makeITfair)及國際金屬勞連(International Metalworkers’ Federation)的聯合聲明

荷蘭阿姆斯特丹,香港,瑞士日內瓦 - 2010年10月12日 - 今天,香港勞工組織大學師生監察無良企業行動(SACOM)發佈題為《富士康的軍事化管理:工人異化成機器》的報告,揭示富士康在深圳及杭州廠房的勞工狀況。在本年1-8月期間,17名年輕的富士康員工相繼自殺輕生,造成13宗慘劇。事件震驚全球,電子業界空前震動。遺憾的是根據SACOM的調查報告,富士康及其世界知名的品牌客戶,包括蘋果(Apple)、惠普(HP)及戴爾(Dell)等,並沒有就富士康的勞工及管理問題作出適切及公開透明的回應。我們聯合緊急呼籲所有電子品牌企業負上法律及社會責任,為全球電子產業供應鏈內的一綫工人提供體面的勞動條件。全面深入改革採購模式,已然是最為迫切的第一步。

SACOM的報告結論指出富士康的用工手法既不合法也不道德。電子品牌的採購模式,也直接對工人施加壓力。SACOM是根據其在本年5月22日至9月21日的田野調查,以及案頭研究,作出上述結論。

工資

10月1日,富士康指出深圳的前線員工月薪已上調至人民幣2,000元。富士康更表示85%員工獲得加薪。 然而,SACOM對此說法深表懷疑。迄今,SACOM發現富士康的深圳員工仍未接獲公司有關加薪的正式通知。加薪的條件,例如:年資及僱用模式,仍未明朗。加上,SACOM發現,富士康在近月取消或減少給予員工的補貼及獎金等。此外,富士康亦未有公開其他地區的加薪方案。SACOM倡議,按照中國不同城市的生活水平,生活工資應界乎人民幣1686元至2,293元。

工作時間 在連串的自殺事件後,富士康將每月加班工時限制在80小時的水平,但仍遠高於法定的加班不得多於36小時的標準。工人對SACOM表示,新 “控制加班時數”實為做假,員工部份加班不會被紀錄下來,換言之就是剋扣加班工資。富士康的前線員工每日上崗前及下班後都有集會,每週亦有工作會議。在會上,管理層都會告誡員工有關產量及品質的要求,以及指出員工的紀律的問題。而這些會議有時長達1小時,工人必須參與及可是卻不計算在工時之內。同樣,工人參與培訓,工時亦常被被剋扣。因此,深圳工人雖然在6月加薪,整體工資卻不見得有增長。

管理制度 SACOM指出富士康絕對服從的文化是由招聘開始,已植根員工的心中。員工常因’犯錯',包括:產量未能達標、出錯或上厠所超時而受罰。紀律處分行動,例如:記小過,要員工公開承認錯誤,管理會在其他員工面前斥責及侮辱犯錯員工,甚至要求員罰抄郭台銘的語錄。此外,富士康保安人員也被指對員工打罵。而嚴苛的管理,不單在廠房內發生,即使工人回到宿舍,也要受嚴格的規則的束縛,例如:使用吹電風筒也被禁止。如有違返宿舍規則,工人將被逼寫悔過書。

搬遷 目前,富士康在中國的員工超過90萬人,單單在深圳,就至少有42萬名員工。在連串自殺慘劇後,富士康加速了其向中、西、北部搬遷的計劃。相信是與當地的充足的勞動人口及較低的工資水平有關。可是深圳的工人沒有被知會搬遷的事宜。更清楚不過的是,工人根本沒有選擇的權利,他們只可選擇接受搬遷的指令,或是辭職。而搬廠也意味著不少深圳員工無法享受加薪。

瑞士民間團體Bread for All的Chantal Peyer表示:「在是電子品牌長期壓榨供應廠的結果。當蘋果等電子品牌獲得雄厚的盈利,蘋果的盈利更高達40%以上。相反,其供應廠的毛利約為4%。可是,品牌卻是一再壓低單價。因此,勞工的工資更被進一步壓低,生活工資遙遙無期。」

在龍華廠區雖然設有工會,但受訪工人皆表示工會缺乏認受性。工會委員會並非由民選產生。富士康工會聯合會的主席,更是富士康的「對外辦公室專理」,也有報導指陳為總裁郭台銘的秘書。當有員工有感權益被侵害而向工會求助時,工會卻叫員工將問題向人力資源部反映。簡言之,員工並沒享有《工會法》所訂定的組織權利。

SACOM項目幹事陳詩韻指出:「連環自殺慘劇後,富士康把自殺的成因歸咎於受害者的「個人問題」,拒絕承認與其管理模式有關。至今,富士康的管理依然嚴苛。工人怎樣才可透過與管理的溝通與集體協商改善管理制度?富士康應為員工進行勞工權利培訓,而工會亦應改革,使其更民主及向工人問責。」

學生工 SACOM發現在富士康部份部門,學生工比例高達三分之一到一半。2010年6月,大約有10萬名河南省的職業學校學生被組織到富士康深圳廠區工作。中國政府規定,實習應乎合學習目標及教學計劃,而實習生每天的工作時間亦不得多於8小時。SACOM批評富士康的實習計劃與生產線上工人的工作無異,而他們每天也務必加班。再者,實習也不是自願性質,學生只能接受校方安排。

生產安全 SACOM發現,工人缺乏足夠的個人勞保用品和安全培訓。有工人表示,由於車間欠缺安全和健康的工作條件,使員工流失率甚高。而工人辭職後,富士康亦沒有安排離職前的健康檢查,違《中華人民工和國職業病防治法》第32條。

「電子行業應該承認,富士康的問題並不是孤立的;富士康的自殺事件只是整個全球電子供應鏈上勞工問題的冰山一角。」全球電子業勞工及環境倡議運統籌Pauline Overeem 說:「富士康在印度、捷克、墨西哥和其他國家,為所有主要的電子消費品牌代工,是而富士康的競爭對手亦都一樣如此。品牌公司及合約製造商都應就勞工權益承擔責任,並採取相應的行動。這是整個行業的責任,而行業協會電子行業公民聯盟EICC( Electronic Industry Citizenship Coalition, EICC)及全球電子可持續性倡議(Global e-Sustainability Initiative , GeSI) 應該扮領導的角色,確保工人的勞動標準得到尊重,特別是工人的自由結社權和集體談判權等兩項關鍵。」

今年5月底自殺事件後,EICC的已成立了一個由多個公司組成的工作小組。公平電子貿易聯盟項目統籌Irene Schipper 指,「EICC現在該向我們展示,他們究竟會採取什麼行動了。如今形式十分緊迫,但他們至今仍未有任何實質行動。」

1 June 2010, GoodElectronics, together with makeITfair, issued a joint public statement. Core message: Foxconn and its customers must investigate Foxconn suicides and to address the root causes of this situation. GoodElectronics supported the demands for reform as expressed by Chinese and Taiwanese civil society and the international solidarity campaign. GoodElectronics called upon Foxconn to be a responsible employer and to show humanity to the families of the victims and the injured workers. Besides following the law, Foxconn should provide for adequate financial and psychological support for the victims as well as look after the current workers.

17 September 2010, SACOM, GoodElectronics and Bread for All sent in their nomination of Foxconn as worst company of the year 2010, to compete for the Public Eye Award. The nomination of Foxconn is justified by a series of suicides at a number of Foxconn production facilities in China beginning this year, and by Foxconn as well brand buyers’ irresponsible and insensitive reactions to this human tragedy.
